The following are the terms and conditions (the “Terms and Conditions”) of 2
Became 4 Limited (“We”, “Us” or “2 Became 4”) and sets out the conditions on
which we do business with you (the “Customer” or “Prospective Customer”). It
specifically pertains to how do we business through our Internet website (the
“Website”). All reference to goods refers to official products listed and
supplied by 2 Became 4.
These terms apply to any goods provided by 2 Became 4 Limited, registered office
26, Grange Road, Cheddleton, Staffordshire, registered company number
6600376.
PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE PLACING AN ORDER WITH
US.
1. Ordering of Goods
1.1 All orders of goods from 2 Became 4 are subject to availability and
acceptance by us. We will contact you in the event that any goods you have
ordered are unavailable. You will have the option either to wait until the
goods in question are available from stock or to cancel your order.
1.2 In the event that we are unable to supply the goods you have ordered and you
have therefore decided to cancel the order we will reimburse your payment in
full.
1.3 We currently accept the following payment methods ("Payment Method") for
orders: by credit card on-line or by telephone (our payment service provider
("Payment Service Provider") is WorldPay who are owned and backed by Royal Bank
of Scotland (RBS) of the UK). We can also accept payment by paypal or by cheque with a valid
cheque guarantee card.
1.4 If you wish to order goods from us, you may do so by selecting the Add to
Basket for each product that you wish to order at that time. All products sold
by 2 Became 4 are easily accessible from many links throughout the website. This process is the same regardless of your chosen payment
method. You will be given a choice of payment method at the end of the shopping process in the Check Out page.
1.4.1 When you have selected all of the products that you wish to purchase, you
may then checkout your basket by selecting the View Basket button at
the top of the screen and then select the Proceed to Check Out button.
1.4.2 If you are not already signed-in to 2 Became 4, at this point we require
that you sign-in to your previously registered account with us or else register
with us at this time. To register, select the Register button on the
sign-in screen
by selecting sign-in on the top menu. You will then be asked to provide us with
some basic contact details which will be used to correspond with you about your
order and to use when processing on-line credit card payments. We will retain
this information for your future convenience unless you notify us otherwise. WE
DO NOT STORE DETAILS ABOUT YOUR CREDIT CARDS WITH YOUR ACCOUNT INFORMATION. If
you register with us, we will send an email to you to confirm your registration
and ask you to verify your account by following the enclosed link at your
convenience. The order process is unaffected by this.
1.4.3 When you have signed in, you will be presented with a final view of your
shopping basket together with a breakdown of the costs, any discounts applied,
the calculated postage amount and the total payment amount required. At this
point you may also change the delivery details for the order. Before placing
your order with us, please also select a method of payment.
1.4.3.1 Once you have selected your payment method, select the Place Your Order
button. Your order will now be saved in our order system. If you you selected to pay by
credit card on-line, you will be redirected to our on-line payment provider who will
process your payment immediately, otherwise you will be redirected to the order confirmation
page. In either case, you will receive an email to confirm your order and our intention to
process your order and send the goods to you. This email will also act as a receipt for your
purchase.
1.4.3.2 If you choose to pay by cheque, you will be given the reference number
for your order and instructions on where to send your payment. You must make
your cheque payable to 2 Became 4 Limited and send it to our address listed in
our Contact Us page. Please write your Order Number
clearly on the cheque so that we can identify your payment.
1.4.3.2 If you choose to pay by credit card by phone, you will again be given
the reference number for your order and details of our telephone number. You
may call us on (from inside the UK) 0870 950 2884 or (from outside the UK) +44
870 950 2884 or we will call you (usually within 48 hours), which ever comes first.
1.5 Once we have received your payment, it is at this point at which a legally
binding contract exists between us. The email will contain a Website link to
these Terms and Conditions and we assume you agree to be bound by these at this
point.
1.6 You have the right to cancellation of your order at anytime before we have
processed your order (normally within 24 hours of receipt of your order).
1.7 Orders cannot be accepted from customers under the age of eighteen (18)
years.
2. Pricing
2.1 All prices of goods quoted on the Website are inclusive of VAT and exclusive
of postage or shipping costs.
2.2 Our postage prices are based on either on a flat rate dependant on your location
(UK or International) or on a per item courier price dependant on your location
and the size and weight of the object. Per item priced goods are typically pushchairs
and equivalent sized items.
2.3 We reserve the right to change our prices for goods and postage at anytime.
2.4 When you have contacted us to place an order of goods, the prices quoted
will remain as agreed for a period of not more than 30 days from the time of
first contact regarding the order or until we have received payment from you.
2.5 If you contact us as an enquiry and if we quote to you a price for goods or
postage, these prices will remain for period of not more than 7 days from the
date of the quote.
3. Delivery
3.1 We have a business agreement with Royal Mail of the UK and our rates are
based on this agreement.
3.1.1 For delivery in the UK, our postage pricing is based on the total weight
of all of the goods ordered. Please see our delivery
information page for specific details.
3.1.2 For delivery to Europe, our pricing is based on a pro-rated flat rate of
the total weight of the goods ordered plus a per-package pricing. Please see
our delivery information page for specific
details.
3.1.3 For shipment elsewhere, you must first contact us so that we can confirm
that we can ship to you in an economic and reasonable timeframe.
3.2 Incorrect delivery details may lead to delays in the delivery of your goods,
so before placing your order, please ensure that you have included the full
address details, including accurate postcode of the intended recipient and your
daytime contact telephone number in the event that any delivery problems are
encountered.
4. Returns and Cancellations
4.1 Only goods purchased from 2 Became 4 may be returned to us.
4.2 Orders for goods may be amended or cancelled at any time up to 14 working
days beginning on the day after you have received the relevant goods (the
“Cancellation Period”). No returns will be accepted after the cancellation
period.
4.3 Any goods you return to us during the Cancellation Period must be in new,
unused and unworn condition with all the original packaging and garment tags
still attached.
4.4 All goods that you wish to return should marked as a RETURN
and include, if possible, your original Order Number and Customer
Number. Goods must
be returned to the address listed in our Contact Us page. If you do not include
these details we can still process your return, however it will take longer to process
and trace and may result in a delay to you for any refund, replacement or repair.
4.5 In the event of any failure to return any properly cancelled goods we shall
have the right to charge any costs of recovery of the goods.
4.6 Any goods cancelled by you should be returned within 14 days of the date of
your notice of cancellation.
4.7 If you paid by cheque, we will credit you with the original amount by cheque
excluding taxes, duties and delivery costs within 30 days from the date of
notice of cancellation. This period may be subject delay if returned goods are not properly
marked or are not returned to the correct address.
4.8 If you paid by credit card, we will refund your credit card with the
original amount using our payment service excluding delivery and on-line
transaction charges.
5. Disclaimer
5.1 Whilst we agree to use our reasonable endeavours to ensure that the Website
is fully operational and error-free we cannot guarantee this and therefore
accept no responsibility for any defects and/or interruption of the Website and
shall be released from our obligations under these Terms and Conditions in the
event of any cause beyond our reasonable control which renders the provision of
the Website impossible or impractical.
5.2 We exclude, to the fullest extent permitted by applicable laws, and save in
respect of death or personal injury arising from our negligence, all liability
of any claims, losses, demands and damages arising directly or indirectly out
of or in any way connected with the goods supplied by 2 Became 4 or your use or
inability to access the Website. This exclusion shall apply in respect of,
without limitation, any costs, loss of profits, loss of contracts or business
opportunity, loss of data and any other consequential, incidental, special or
punitive damages, even if we have been advised of the possibility of such
damages, whether arising in contract, tort, under statute or otherwise or due
to representations (other than fraudulent or negligent misrepresentations)
PROVIDED THAT nothing contained in these Terms and Conditions affects or will
affect the statutory rights of the customer or the recipient in relation to the
quality, fitness or description of the goods supplied.
6. General
6.1 We reserve the right to supplement and amend the Terms and Conditions on
which you are permitted access to the Website from time to time. Any changes
will be posted on the Website and it is your responsibility as a customer to
review any changes on accessing the Website. Changes will be effective five (5)
hours after the posting of any such change.
6.2 Additionally, we reserve the right to suspend, restrict or terminate access
to the Website for any reason at any time.
6.3 These Terms and Conditions shall be deemed to include all other notices,
policies, disclaimers and other terms contained in the Website, provided that
in the event of a conflict between any other terms, these Terms and Conditions
shall prevail. If any of these Terms and Conditions is held to be invalid or
enforceable, the remaining provisions shall remain in full force and effect.
6.4 No waiver by us shall be construed as a waiver of any preceding or
succeeding breach of any provision.
6.5 If any part of these Terms and Conditions shall be deemed unlawful, void or
for any reason unenforceable, then that provision shall be deemed to be
severable from the Terms and Conditions and shall not affect the validity and
enforceability of any of the remaining provisions of the Terms and Conditions.
6.6 We shall ensure that we comply with the requirement of all current data
protection legislation including, without limitation, the Data Protection Act
1998 (as replaced, modified or re-enacted from time to time). We shall only use
personal data received from you for the purpose of fulfilling our obligations
under these Terms and Conditions.
6.7 These Terms and Conditions shall be governed by and construed in accordance
with English law and the parties agree to submit to the exclusive jurisdiction
of the English courts.
7. Website Content and Copyright
7.1 All Website content including text, picture images, logos, symbols, HTML or
any programming code is protected under international copyright law © to 2
Became 4 or our suppliers and service providers.
7.2 Use of any content on the Website outside of it's specified purpose will be
deemed an infringement of copyright law and will be prosecuted as such.
7.3 Claims ownership without prior agreement with 2 Became 4 or with intent to
falsify identity or steal intellectual property will be deemed an infringement
of copyright law and will be prosecuted as such.
